Final ACA Reporting Forms and Instructions for 2022 Calendar Year
The IRS has released final Affordable Care Act (ACA) information reporting forms and instructions for the 2022 calendar year, as well as final regulations that permanently change the deadline for furnishing Forms 1095-C to individuals. The extension of 30 days after January 31 is now automatic. Applicable Large Employers (ALEs) must file the Form 1094-C, as well as copies of the Form 1095-C provided to employees with the IRS no later than March 31st of each year, if filing electronically. If filing by paper, which is permitted only for employers who must file fewer than 250 returns, ALEs must file no later than February 28th/29th of each year.
Here are the three important deadlines for filing 2022 information:
- March 2, 2023: (new permanent) deadline for furnishing the written statement (Form 1095-C) to full-time employees.
- February 28, 2023: deadline for filing Form 1094-C transmittal (and copies of related Forms 1095-C) with the IRS, if filing on paper.
- March 31, 2023: deadline for filing Form 1094-C transmittal (and copies of related Forms 1095-C) with the IRS, if filing electronically. Electronic filing is mandatory if the ALE is required to file 250 or more Forms 1095-C for the 2022 calendar year.
